Requests for Preliminary Rulings to the CJEU

Finnish courts must, if necessary, request a preliminary ruling from the Court of Justice of the European Union on the interpretation of EU law in a pending case.
The Court of Justice of the European Union has jurisdiction to give preliminary rulings on the interpretation of the Treaties or on the validity and interpretation of acts adopted by an institution of the Union.
A preliminary ruling is a final determination of European Union law, with no scope for appeal. The judgment of the Court of Justice is also binding on other national courts when tehy deal with the same question of law.
The decision by the SAC to request for a preliminary ruling is always made by the panel hearing and deciding the case.
